Berkshire County was created by law from Hampshire County on 21 April 1761, being the western third of the county over the mountains. The act took effect on 30 June 1761. The first matter recorded was a probate on 30 July 1761. 

In the survey of state records published in 1889, the probate books and files were in good condition and complete. Each volume has its own index. The original indexes, dockets, records, and files from 1761 to 1865 are at the Judicial Archives in Boston. Records after 1865 are at the county office in Pittsfield:

Most of the records have been microfilmed. These microfilms can be found at the Judicial Archives at the Mass. Archives in Boston, the New England Historic Genealogical Society in Boston, and at the Family History Library in Salt Lake City as:
